We have two, August 2020 ABI model, luxury 8 berth caravans closely for hire. Both located closely together in the peaceful development of Tattershall Country Park – Swan View.

Booking Terms & Conditions

By making this booking and paying your deposit you are agreeing in full to the following Terms & Conditions. These T&Cs have been produced to protect the Property owner and all guests as well as providing advice in the event of problems or disputes. The person making the booking accepts full legal liability on behalf of all guests. Bookings are not secure until the initial deposit is paid and funds cleared. Failure to pay the balance by the agreed date will result in the loss of your holiday booking.

By agreeing to these terms and conditions and paying your deposit / bond, you accept to be legally liable to comply with these terms.

General

These terms and conditions (the “Booking Contract”) are between and shall bind the property owner or manager (“we”, “us” and “our”) and the holidaymaker(s) who book our property (the “Property”). References to “you” or “your” are references to the person making the booking and all members of the holiday party.
Any Booking is subject to the Booking Contract. This Booking Contract and our confirmation email contain the entire agreement between us and you and forms the basis of your agreement with us so please read them carefully.

Site Operator Terms

By entering into a booking with us you also agree to the following terms set out by the site operators Away Resorts: The following terms and conditions will apply to your booking. The person who books the holiday by telephone, internet or via email will be accepting the booking conditions on behalf of the holiday party. Please ensure you read and understand the booking terms and conditions prior to booking. A contract will come into existence immediately between you and the company which owns the Park and us. It is your responsibility to ensure that all members of your party accept the terms of the contract set out in these terms and conditions of booking. Failure to disclose all relevant information or comply with these terms may lead to termination of the contract and loss of the booking. The site operators and we reserve the right to decline or terminate the booking of any guest(s) whose behaviour interferes with the general comfort and safety of other guests and staff. In this event, no refunds will be made. This may include, but is not limited to, verbal or physical abuse and will be up to the management’s discretion. We cannot be held responsible for other people’s behaviour whilst on holiday with the site operator.

Data Protection

The information you give us in connection with your booking is held securely on our computer system and dealt with in accordance with the Data Protection Act. By providing us with the information you are deemed to accept this and to have the consent of all members of your party to both us and the site operators holding this information for the purposes of your holiday booking, to help us improve our service to you and to provide you with information about our holidays. We will not disclose this information to any person outside the Site Operators without your agreement, other than our agents for the purpose of your holiday booking unless we are legally required to do so or for crime prevention purposes. There may be CCTV cameras at some locations on the Holiday Park for crime prevention and safety reasons.

CCTV

CCTV is in operation at the property to ensure the safety of guests and the property.

The camera captures footage of the outside of the property from the side door to the parking space at the front of the property. No other areas of the property indoors or outdoors are monitored by CCTV.

CCTV footage is recorded and is stored securely for the purpose of monitoring the safety of guests and the property. Footage is deleted regularly when no longer needed.

By signing these Terms and Conditions guests are agreeing to the recording of footage of the above areas of the property during their stay.

Making your Booking

All bookings are subject to availability and we reserve the right to decline any request based on but not limited to factors such as unavailability, unsatisfactory makeup of party etc.

The booking fee must be paid within 24 hours to confirm booking.Dates will be released after this period, without further warning. Provisional bookings without payment of the full deposit will not be accepted under any circumstances

Full Name, contact number, email address and number of guests will be required at time of booking.

We do not accept bookings for hen/stag nights .Should the makeup of any party be deemed to be in breach of site operators policy or to be likely to cause disturbance to the general comfort of other guests on site booking requests will be declined and any amounts paid refunded in full.

By submitting a reservation request and making payment of booking deposit you enter into a contract and a booking is deemed to be effective once we email confirmation to you to this effect, this contract will be effective from the date the confirmation is sent by us.

Bookings made via other sources, ie email/phone etc: you will be emailed a booking form/agreement which should be completed, signed and returned with details of guests included within the party either by Email or Post together with a booking deposit of £100 or full payment if required to secure dates.

By submitting reservation requests/returning a booking form and deposit/full payment you agree to abide by the conditions set out in this contract and stated on the booking form/agreement. The Booking shall be made and this Booking Contract shall be effective once the booking fee and the Initial Deposit of £100 or full payment has been received by us and you have received an email from us confirming the Booking at which point the Cancellation Policy (as defined below) will be effective;

If the Quote or Booking Request Form requires that you

Make a payment in full, then you must pay the full amount for the Booking and the booking fee to us by the due date; or pay an initial deposit (the “Booking Deposit”) followed by a balance payment (the “Balance”), then you must make both payments to us within the specified time periods. Reservation/booking requests for arrivals within 4 weeks will be required to make payment in full at time of booking request.

You shall be required to pay an additional damage deposit of £100 (the “Security Deposit”), as part of your payment in full or your Balance payment (as applicable)

You should carefully check the details of the Quote before making any payment to us regarding your Booking, as well as the confirmation email and inform us immediately of any errors or omissions.
Entertainment Passes are not included in your booking price; however, these can be purchased from the Main reception desk via Away resorts.

Paying for your Booking

Where you have only paid the booking fee and/or an Initial Deposit, you are required to send to us your payment for the Balance and the Security Deposit within a certain period prior (4 weeks) to the arrival date specified in the email confirmation. If you fail to make the balance payment due to us in full and on time we shall be entitled to treat your Booking as cancelled by you and the Cancellation Policy (as defined below) shall apply.
The Damage Deposit may be used for any repair and/or replacement of the property, furnishings, fixtures, and fittings that are necessary after your stay. We will return the Damage Deposit to you following the return of the keys to us, less any deductions in accordance with the conditions listed above within 48 hours of departure.

If you cancel or amend your Booking

If you need to cancel or amend your Booking you must write to us or email us as soon as possible. A cancellation or amendment will not take effect until you receive confirmation from us. The cancellation policy described in your email confirmation (“Cancellation Policy”) applies to your Booking we will refund any amounts due to you in accordance with the agreed Cancellation Policy.

In the event that

Any balance required from you is not paid in accordance with the time frames set out in the Cancellation Policy; or you do not arrive at the property within 24 hours of your arrival time without notifying us, then we shall be entitled to treat your Booking as being cancelled by you and the Cancellation Policy shall apply.

Before your Holiday:

Guest Passes / Entertainment

If you plan on using the facilities we now have to purchase entertainment passes (guest passes) on your behalf.

If you require guest passes this will need to be arranged through us. Passes will then be sent to you once payment is received in digital form of a QR code which will be scanned by the park staff when you wish to use the facilities. These can be shown via your phone or printed off. The passes will give access for the dates of the holiday only + for the chosen number of guests.

This will also be included in your booking confirmation along with a booking reference you can use once the booking has been made.

We strongly advise all guests you book early to avoid disappointment as they have reduced numbers due to Covid and increased visitors due to staycations being more popular than ever. This includes swimming, and dining at the restaurants. If passes are not purchased prior to your stay this may lead to delays on site and accessing the facilities.

All of these facilities and activities will have COVID capacity restrictions and will be bookable in advance.

You will be able to book up to 21 days in advance only and this will be on a rolling schedule per day.

We provide a self-catering holiday home ONLY and we will not be responsible for any pass or activity related issues. Any complaints due to facilities or away resorts will need to be addressed to Away Resorts at Guest Services.

Peak and off peak dates along with pass prices are set by Away Resorts. (We are an 8 berth and you will be charged 8 berth prices even if there are less than 8 people – this is set and priced by Away Resorts).

Travel Insurance

It is highly recommended that you arrange Comprehensive Travel Insurance.

This will help protect you and the other guests in the event of injury, damage, theft, loss of belongings and cancellation. Please be aware some insurance companies require proof of a positive Covid-19 test within 14 days of your break should you wish to cancel on this basis.

Please Note:—The owner may not refund you if they are not responsible for the cancellation.

Permitted Guests

Only the person making the booking and those listed on the booking confirmation  will be allowed to occupy the Property. This means that you cannot sell or give the holiday to someone else. Anyone, other than the persons, found to be occupying the property will be asked to leave.

a) The nominated group leader will be subject to fines in the event of misconduct by any of the group members that is not satisfactorily resolved, as detailed below.

b) The nominated group leader accepts full responsibility and liability for the conduct of all guests should they breach any of the rules. It is their responsibility to ensure that all the guests are aware of the full details of these terms and conditions.

c) Extra guests are not allowed to stay overnight in the Property, without written permission, from the owner. You may have visitors during the day only.

d) The holiday must not be sold on to someone else. The owner must approve any changes which may incur charges.

e) The maximum occupancy as allowed at the time of booking is not to be exceeded.(this total includes babies, infants and children).

f) Children under the age of 16 must not be left unattended.

g) Pets of any description must not be brought into the property without prior agreement with the owner

The Property

You can arrive at the Property from 15:30 on the Arrival Date for your holiday and you must leave by 10:00 am on the departure. Please see the Cancellation Policy for further details. All guests are required to abide by the site operator rules at all times.

The caravan includes:

Only the vehicles registered on the booking form are permitted to park at the property – maximum of 2 cars. Any further vehicles not registered at the time of booking will be asked to leave the park as this is in violation of the pitch agreement.

Eviction from the property

a) You will be evicted from the Property, by the Property owner or Property site management, and your deposit will not be refunded in the event of, but not limited to:

i. Unreasonable behaviour by any of the guests

ii. Additional, unregistered guests being found in the Property

iii. Smoking in or damage to the Property or any of its contents

iv. Pets being taken into the Property

v) Lost keys will incur a loss of security deposit and any damages to the property and or it contents will be automatically deducted from security deposits. In the case where damages costs incurred are more than the deposit, you are responsible to pay these costs and they will be billed directly to the person who made the booking for which payment will be required within 7 days of charge being notified.

Your obligations

You agree to comply with the regulations set out in any property manual at the Property and any other regulations reasonably specified by us from time to time. You agree to comply with the regulations set out by the site operators (Away Resorts) and ensure that they are observed by all members of your party, any member of the party which acts in a way that the site operators consider unreasonable may be asked to leave the site and no refunds will be issued under those circumstances. You agree to keep and leave the Property and the furnishings, including items such as kitchen equipment, crockery, and glasses clean and in good condition. You agree not to cause any damage to the walls, doors, windows or any other part of the Property nor to do anything that may be reasonably considered to cause a nuisance or annoyance to us or to any other occupier of adjoining or neighbouring properties. Should any member of your party behave in a manner which is considered to cause a nuisance or annoyance to other site guests the park operators may require that the whole party leave and this will be considered a breach of this contract and no refunds will be due. You agree to take all necessary steps to safeguard your personal property while at the Property. You agree to ensure that each member of your party is covered by comprehensive travel insurance (including cancellation, flight delays, loss and damage to baggage and other property) and health insurance (including evacuation and repatriation coverage). You cannot allow more people to stay in the Property than expressly authorised, nor can you significantly change the makeup of the party during your stay in the Property, nor can you take your pet into the Property. If you do so, we can refuse to hand over the Property to you, or can require you to leave it. We will treat any of these circumstances as a cancellation of the Booking by you and we shall be under no obligation to refund you for any fees already paid to us in those circumstances. Any refund will be at our sole discretion. You agree to allow us or any representative of ours access to the Property at any reasonable time during your stay for the purpose of essential repairs, in an emergency or to ensure you are complying with this Booking Contract.

COVID-19

Bookings and guests staying must be in accordance with Government Legislation at the time.

Guests will be asked to provide proof they are one family unit if required and asked to sign a declaration at guest services. If this cannot be proved guest passes may not be issued by guest services.

If you or any of your party shows any signs of Covid-19 please do not attend site under any circumstances.

Cancellation due to Covid-19

Should the park be closed due to local or national lock down measures a full refund of any monies paid will be issued.

If you have to cancel as you are unable to travel due to local lock down measures (eg: you have moved from Tier 2 to Tier 3), you have tested positive for Covid-19, or you have to self-isolate, we shall offer you the opportunity to move your holiday dates to another time. Should the cost of the revised break be more than the original booking the difference will need to be paid.

We recommend all guests take out appropriate holiday insurance to cover these eventualities. Please be mindful that some holiday insurance companies require proof of a positive Covid-19 test within 14 days of the break for a refund to be issued by the insurer.

Track & Trace

Completion of the track and trace form is compulsory before arrival or you will not be given access to the park. This must be completed using the following link: http://www.awayresorts.co.uk/tracker

It is your responsibility to register prior to your arrival using the above link on the emailed confirmation.

RAF BASE

Tattershall Lakes Country Park is located close to RAF Coningsby. Aircraft noise, can be, and is expected. Night flying takes place throughout the year & we are not held accountable for any noise disturbance.

Parking

A maximum of 2 vehicles can be parked outside the Property, please ensure you park only in designated spaces. More than 2 vehicles outside any one caravan is in violation of the owners pitch agreement and you will be asked to remove it from the site.

Footwear

Please do not wear stiletto heels on any areas of soft flooring, as this may cause damage to it Be mindful of dirty/muddy footwear when entering the Property, cleaning of carpets can be costly and may delay the turnaround time for the next guests. It is preferred that all footwear is removed upon entering the property.

Hot Tub

Care should be taken with the hot tub lid, no standing or sitting on the lid as it is very delicate. The hot tub is professionally maintained and checked during your stay. Guests are liable for any damages incurred to the hot tub or hot tub lid.

a) Shower before use.

b) No fake tan / lotions / oils to be worn.

c) No glasses to be used – please use the plastic glasses provided.

d) No sitting on the side of the tub.

e) No jumping / diving

f) No electrical items to be used around the hot tub

g) No sitting or standing on the lid.

f) The lid should be replaced after use.

g) Children must be supervised at all times

h) Be careful entering and exiting – The floor can get wet and slippery

i) We accept no responsibility of injury caused by use or misuse of the hot tub

j) Please be curtious to our neighbours- No loud music / parties.

k) No bright easy wash hair dyes – These can stain the lining of the tub and cleaning charges will be passed on.

l) No eating or smoking in the hot tub.

m) Please contact a doctor before using the hot tub if you are pregnant or have any heart conditions.

Complaints

Every effort has been made to ensure that you have an enjoyable and memorable holiday. If however, you have any cause for complaint it is important that remedial action is taken as soon as possible. It is essential that you contact us if any problem arises so that it can be speedily resolved. It is often extremely difficult (and sometimes impossible) to resolve problems properly unless we are promptly notified. Discussion of any criticisms with us whilst you are in residence at the Property will usually enable any shortcomings to be rectified straightaway. In particular, complaints of a transient nature (for example, regarding preparation or heating of the Property) cannot possibly be investigated unless registered whilst you are in residence at the Property. If any complaint cannot be resolved during your holiday, you must write to us or email us with full details within 28 days of the end of your Booking. For the avoidance of doubt, you shall always contact us if you have any complaint in relation to your Booking or the Property.

Limit of Liability

Our maximum liability for losses you suffer as a result of us acting in breach of this Booking Contract is strictly limited to the amounts received by us in relation to your Booking. We shall not be liable for any losses which are not a foreseeable consequence of us breaching this Booking Contract. Losses are foreseeable where they could be contemplated by you and us at the time your Booking is confirmed by us. Your Booking is made as a consumer for the purpose of a holiday and you acknowledge that we will not be liable for any business losses howsoever suffered or incurred by you. This does not exclude or limit in any way our liability for death or personal injury caused by our negligence or for fraudulent misrepresentation; or for any matter for which it would be illegal for us to exclude or limit, or attempt to exclude or limit, our liability.

Law and Jurisdiction

This Booking Contract (including any non-contractual obligations arising under or in relation to this Booking Contract) between you and us is governed by the law of England and Wales and we both agree that any dispute, matter or other issues which arises between us will be exclusively dealt with by the Courts of England and Wales.

Miscellaneous

You may not transfer your Booking or any rights and responsibilities under this Booking Contract to any other person, without our prior written consent. If at any time any part of this Booking Contract is held to be unenforceable for any reason under any applicable law, that part shall be deemed omitted and the enforceability of the remaining parts shall not in any way be affected by that omission. This Booking Contract, together with the Cancellation Policy and our confirmation email contain the entire agreement between us and you relating to the Booking and shall supersede any previous agreements, arrangements or discussions between you and us, whether oral or in writing. No representation, undertaking, or promise shall be taken to have been given or be implied from anything said or written in negotiations between you and us prior to receiving the confirmation email except as expressly stated in this Booking Contract. Neither you nor we shall have any remedy in respect of any untrue statement made by the other upon which that party relied in entering into this Booking Contract (unless such untrue statement was made fraudulently) and that party’s only remedy shall be for breach of contract as provided in this Booking Contract. We will not be in breach of this Booking Contract, or otherwise liable for any failure or delay in performance, arising from any circumstances beyond our reasonable control including, without limitation, flood, fire, explosion, equipment failure or accident. We will not be in breach of the Booking Contract should the site operators require the termination of occupancy of the premises due to the behaviour of any member of the party which is deemed to be a breach of site operator rules.

Cancellation Policy

If you cancel or amend your Booking

Should you need to cancel your holiday the following refunds/charges will apply:
Cancellations prior to 12 Weeks prior to stay – Full refund will be paid of amounts paid minus an administration fee of £50;
Cancellations up to 4 weeks prior to stay – refunds will be made for cancellations and full amounts paid will be refunded. Should the circumstances be exceptional we may decide to refund amounts paid at our discretion minus a £50 cancellation fee if the booking is within 4 weeks. Should you vacate the property earlier than expected no refunds will be applicable. No refunds will be made in respect of any cancellation of party members – the fees charged are based on the property and not the occupancy, therefore, no reductions will be offered for smaller party size, likewise no additional charges will be made should you add members to your party providing this has been done at least 8 weeks prior to arrival and written confirmation has been received from us via Email and subject to maximum occupancy levels. We reserve the right to decline any booking on the grounds that the make-up does not comply with site rules and refund any deposits paid. We do not allow pets in our holiday home and any guests who are found to have broken this rule will be asked to vacate immediately, should this occur no refunds will be issued as you will be in breach of this contract and forfeit rights to refunds.

Additional Fees

Additional Charges may apply for early/late check out by prior arrangement. Standard check in is from 15:30pm on day of arrival and standard check-out is by 10:00am on the day of departure. Facility passes are not included in the cost of your holiday.

At the end of your stay

If you leave the Property before the agreed departure date, you will not receive any compensation, unless the Property owner has failed to provide the advertised holiday. Situations beyond the control of the owner will not be considered as fair reason for refund.

Please leave the property clean and secure.

The Property should be left in a clean and tidy state. Please take all rubbish to the rubbish disposal area.

All personal belongings must be removed

Please ensure that all items that belong in the Property are left in the Property — towels, bedding, soft furnishing, equipment, and utensils, decorations etc. missing items will be charged for.

All doors and windows must be closed when you leave the Property. Failure to do this risks the security of the Property.

Ensure all keys are put in the key safe and the numbers are mixed up on the dials. You will be liable for the costs of replacing the Locks and all Key Sets if the keys are lost.

The owners/cleaners will take photographs of any mess or damage they find. Please respect our property.

Security Deposits

An additional £100.00 security deposit is payable on all bookings which are refundable assuming no damage/loss etc. within 48 hours of departure. You will be required to provide BACS  details to enable refunds of security deposits. Lost keys will incur a loss of security deposit and any damages to the property and or it contents will be automatically deducted from security deposits with any additional costs billed.
